These terms and conditions of use are written in the masculine gender for convenience only but refer to men and women alike.

My participation in water skiing activity at the Lake TLV compound – the Israeli wakeboarding and water skiing center Ltd. (hereinafter “Site Management”) is subject to my review of these terms and conditions of use and is further subject to my consent to these terms and conditions of use as set forth in this document and the safety instructions posted throughout the compound. 

An adult that is above 18 years may sign these terms and conditions of use.

A minor is required to provide the signature of their parent or their legal guardian on these terms and conditions of use. 

Alternatively, the parent or the legal guardian may provide a power of attorney to an adult escort of the minor that will sign these terms and conditions of use on their behalf by way of the parent or legal guardian signing the power of attorney form on the Internet website of Lake TLV the Wakeboarding and water skiing center (a link is attached hereto). 

I declare that if I ordered an event/activity in the framework of which the participants in that event/activity take part in activities at the compound including cable water skiing I hereby sign this document as an attorney-in-fact on behalf of the parents of the minors that have not yet reached the age of 18 and the parents of such minors have provided to me a signed power of attorney to do that after they reviewed these terms and conditions of use and the safety instructions.  I undertake to make sure that all the names of the minors participating in the activity at the compound, including cable water skiing are attached to this document and that their parents have signed the power of attorney form that I received from Site Management. I declare that I read the names attached and I know such minors and I acknowledge my responsibility as an attorney-in-fact on behalf of their parents in signing this terms and conditions of use document on their behalf. In addition, my liability if a minor is participating in the activity at the site without the consent of their parents is clear to me.

This document was signed electronically and will remain in force for all the activities at Lake TLV without limitation of time. However, Lake TLV – the Israeli wakeboarding and water skiing center Ltd., may pursuant to its discretion request that you renew your signature on the terms and conditions of use even before one year has passed since you first signed them. 

I am aware, and I agree, that my consent to these terms and conditions of use and my details will be kept by Lake TLV – the Israeli wakeboarding and water skiing center Ltd.,  and will be used for lawful business and/or legal purposes, including mailing of marketing information and advertising.

I have been made aware of the provisions set forth in the terms and conditions of use and I am aware that if any of such terms and conditions of use is unclear to me then I may contact the management of Lake TLV – the Israeli wakeboarding and water skiing center Ltd., to receive a further explanation and I undertake not to start any activity until all the terms and conditions of use are clear to me and understood.

I declare that I have seen and understood the training video and the safety signs (attached hereto is a link to the training video and a link to the safety signs). It is clear to me that if I disregard the instructions included in the training video and the safety signs or fail to act according to them, I and other surfers may be subject to hazards that might end in injury and/or death. I was made aware and I am aware that if anything in the training video and/or the safety signs is unclear to me then I may contact the site team to receive a further explanation and I undertake not to start any activity until the training video and the safety signs are clear to me.

I declare that I am healthy and do not suffer from any health restriction that might jeopardize me during the activity at the site, and I undertake to inform the Site Management immediately upon the occurrence of any safety or health incident during my time at the site. 

I declare that I am not pregnant. 

I am aware that surfing under the influence of drugs and/or alcohol is strictly prohibited and might jeopardize me and other people surfing around me.

I undertake to heed the instructions of the site operators and to act according to their instructions. It is clear to me that if I fail to do so I am at risk of injury, cuts, bruises, broken bones, injury to the wrist, dislocating the shoulder, the arms, the legs, the ankles, the back, the head, and the shoulders, of injury from falling or from contact with another surfer, injury to the spine and/or death. 

I am aware that during the activity I must wear a rescue vest and a hard hat and I may not remove them before the end of the activity and only after I leave the water.

I declare that I know very well how to swim and I do not have a problem leaving the water safely and it is clear to me that staying in the water is hazardous and that I must leave the water as soon as possible after I finished surfing or if I fell in the water.

I am aware that after falling into the water I must move toward the nearest bank as soon as possible while paying attention to other surfers and ropes in the water. I am aware that I may not stay in the water after falling in and I must not come close to a rope or another surfer. 

I am aware that at any stage during the surfing, I can leave the holding handle and discontinue surfing and I must do so to prevent injury to me or others in my vicinity.  

I am aware that the use of jumping boards and other installations available at the lake is hazardous and I may not use them. It is clear to me that if I use the jumping boards and the other installations available at the lake I am at risk of injury, cuts, bruises, broken bones, injury to the wrist, dislocating the shoulder, the arms, the legs, the ankles, the back, the head, and the shoulders, of injury from falling or from contact with another surfer, injury to the spine and/or death.   

I am aware that I must hold the handle with both hands and that any other way of holding the handle poses a risk to me and my surroundings.  

I am aware that while surfing I may not come near other surfers and if I am unable to take over another surfer in the water, I must leave the rope immediately to discontinue my surfing.

I am aware that I must pass between the buoys by circling them as was explained to me in the training video and the safety signs.

If I fail to do so I must let go of the rope immediately. It is clear to me that if I fail to do so I am at risk of injury, cuts, bruises, broken bones, injury to the wrist, dislocating the shoulder, the arms, the legs, the ankles, the back, the head, and the shoulders, of injury from falling or from contact with another surfer, injury to the spine and/or death.  

I am aware that if the cable stops, I must leave the rope and get out of the water. It is clear to me that it is strictly prohibited to attempt to re-start surfing from the place where I stopped. It is clear to me that if I fail to do so I am at risk of injury, cuts, bruises, broken bones, injury to the wrist, dislocating the shoulder, the arms, the legs, the ankles, the back, the head, and the shoulders, of injury from falling or from contact with another surfer, injury to the spine and/or death. 

It is clear to me that after falling into the water I must pay attention to the ground that I am stepping on to avoid injury and cuts from objects in the water and it was made clear to me that the management of the site is making efforts to keep the lake and its surroundings clean, however, the site is unable to guarantee that the water is free of any such objects and I am aware that a risk of injury and cuts from such objects in the water exists. In addition, it was made clear to me that bees and/or other insects are present in the area of the lake and therefore I may be exposed to stinging insects. I declare that I do not suffer from any allergy whatsoever and that I understand the risks of being stung.

I am aware that the Site Management is acting to provide a perfect surfing experience, however, in the event of a malfunction in the skiing installation, it may restrict the activity to repair the malfunction as soon as possible.

I am aware that if I discontinue my activity at the site willingly before the “cable time” that I purchased expires I will not be refunded any money whatsoever.

I understand and agree that my participation in the activity is exclusively under my responsibility and that water skiing is a challenging extreme activity that involves risk to those who participate in it, that cannot be completely avoided without impairment to the nature of the activity, including the risk of serious bodily harm, disability, and even death, regardless of whether my use complies with the safety instructions or otherwise, and it is clear to me that I may be injured by the use of any other person of the installations in the compound. 

it was made clear to me that risks are inherent to surfing activity (the list herein below does not exhaust such risks) including cuts, bruises, broken bones, injury to the wrist, dislocating the shoulder, the arms, the legs, the ankles, the back, the head and the shoulders, of injury from falling or from contact with another surfer, injury to the spine and/or death, that might be caused as a result of using or misusing any piece of equipment or installations and/or the lake. 

I undertake the risks, known and unknown alike, of injury, loss, or damage that may occur in the compound, at the park, and the lakes, I am exposing myself to that state of affairs with a positive and clear understanding of the risk involved and while understanding my entitlement to safeguard against it, while electing out of my own free will to participate in the water skiing activity and to undertake the risk anyway.

Subject to applicable law, I hereby release Lake TLV – the Israeli wakeboarding and water skiing center Ltd., its shareholders, managers, employees, and/or anyone on its behalf from any liability for any injury, loss, and or damage harm including bodily harm and/or property damage (even if such property was put in a locker) that will be caused to me during the activity at the lakes in the water and/or at the park or outside the park for any reason whatsoever. 

By signing this document I waive any claim and/or demand against Lake TLV – the Israeli wakeboarding and water skiing center Ltd.,  and/or any of the representatives.

It is hereby expressly agreed that the competent courts in Tel Aviv-Jaffa will have exclusive jurisdiction to hear any dispute and/or disagreement and/or any other matter relating to this form of terms and conditions of use and/or anything arising from it. The Site Management will be entitled to liquidated damages from me in the amount of 750 NIS if a hearing in court takes place at a court that is not located in the Tel-Jaffa district.

Photography – I am aware and I agree that the site operates cameras that photograph and record the activity on video. I provide consent hereby that Lake TLV – the Israeli wakeboarding and water skiing center Ltd. may make any use pursuant to applicable law and pursuant to its exclusive discretion of the photographs and the footage in which I and/or my minor children appear, and I confirm that I will not have any claim or demand in this regard including for monetary compensation.

I hereby certify by signing herein below that I read this document in full and understood its content.
